Terms of Service

1. Who these terms cover

In these Terms, “Client” means the agent, brokerage, property owner, or authorized representative ordering services. By placing an order, Client confirms that they have authority to request the services and to grant access to the property.

These Terms apply to 360 Realty Photos LLC and its authorized production team. The current version applies to each order unless a written agreement signed by 360 Realty Photos LLC says otherwise.

2. Orders, scope, and property information

Services and deliverables are limited to the confirmed order and invoice. Client must provide accurate property, access, contact, and order information before the appointment and notify us promptly of material changes.

Package pricing uses total finished interior living area, and interior and exterior photography remain included in the applicable photography package. If Client selects an incorrect package, 360 Realty Photos LLC will automatically adjust the order to the verified size tier. Properties above 4,500 square feet require an accepted custom quote before service is performed.

3. Property readiness, access, and parking

Client is responsible for property access, readiness, permissions, safety, pets, occupants, and parking. Client must ensure the property can be safely entered, photographed, and filmed at the scheduled time, and must obtain all necessary consent from owners, tenants, associations, or other decision-makers.

Client is also responsible for providing free or validated parking, or reimbursing documented actual parking cost as described in the Booking Policies. We may decline or pause work where access, readiness, permissions, safety, or conditions are not reasonably suitable.

4. Weather, aerial media, and delivery

Weather, drone restrictions, unsafe conditions, equipment conditions, and site conditions may require us to reschedule, modify, or omit part of an order. Aerial media is always subject to applicable law, airspace restrictions, and pilot safety judgment.

Delivery dates are estimates unless a confirmed order states otherwise. We are not responsible for delays caused by Client, property conditions, third-party platforms, weather, government restrictions, or circumstances outside our reasonable control. Revision availability and timing follow the confirmed order; requests outside that scope may require additional approval and payment.

5. Media rights and permitted use

360 Realty Photos LLC retains copyright in all delivered and undelivered media; no separate certificate is required. After full payment, Client receives a permanent, worldwide, non-exclusive license to use and share delivered media through MLS, Zillow, websites, social media, print, brokerage marketing, and personal business portfolios.

360 Realty Photos LLC may use completed work in its portfolio, website, advertising, and social media without additional approval. Client may not resell, stock-license, independently transfer copyright, or sublicense the media. Brokerage staff and vendors may use the media only while acting for Client or marketing the photographed property.

This license is a permission to use the work; it does not create joint copyright ownership or transfer copyright from 360 Realty Photos LLC to Client or any other person.

6. Third-party platforms and client responsibilities

MLS, Zillow, social-media, portal, hosting, and other third-party platforms maintain their own rules, technical requirements, and availability. Client is responsible for confirming that its intended use complies with all applicable listing, brokerage, platform, and legal requirements.

Client agrees to defend, indemnify, and hold harmless 360 Realty Photos LLC and its production team from third-party claims, losses, or expenses arising from Client-provided information, instructions, lack of authority, property access, or Client’s use of the media, except to the extent caused by our gross negligence or willful misconduct.

7. Limits of liability

To the extent permitted by law, 360 Realty Photos LLC is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost listing opportunities, or third-party platform decisions. Our total liability related to a specific order will not exceed the amount Client paid for the affected service.

Nothing in these Terms limits liability that cannot lawfully be limited. Client’s remedies for a verified service issue are limited to reasonable re-performance, replacement deliverables when available, or a refund of the affected service at our discretion.

8. Changes, governing law, and severability

These Terms are governed by Florida law, without selecting an exclusive county or venue. Events beyond reasonable control—including severe weather, drone restrictions, emergencies, utility failures, labor disruptions, and government action—may delay or prevent performance without breach of these Terms.

We may update these Terms by posting a new effective date on this page. If any provision is unenforceable, the remaining provisions remain in effect. For questions, contact 360 Realty Photos LLC at media@360realtyphotos.com.
